These Terms of Use (“Terms”) govern your access to and use of the Gemiway mobile application (the “App”), operated by Gemiway Ltd, a company registered in England and Wales (“Company”, “we”, “us”, or “our”). By accessing or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the App.
Purpose of the App The App provides automated, AI-assisted informational features designed to support self-reflection, personal insight, and exploratory use related to gemstones and user-provided inputs. The App is intended solely as an informational and self-reflection tool. The App does not provide professional, medical, psychological, therapeutic, financial, or legal services.
Eligibility The App is intended for users aged 13 years or older. If you are under 18, you may use the App only with the involvement and permission of a parent or legal guardian. We do not knowingly provide the App to children under 13.
Accounts Certain features may require authentication through third-party services such as Apple or Google. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You may delete your account at any time. Personal data will be handled in accordance with our Privacy Policy.
Subscriptions and Digital Purchases The App may offer:

paid subscriptions (monthly or yearly)
one-time purchases of digital products, including the Guidebook
Subscriptions purchased through the App are processed exclusively through the Apple App Store or Google Play. Billing, cancellations, renewals, and refunds are governed by the policies of the respective platform provider. The Company does not process these payments directly. Certain digital products may also be offered outside the App marketplace through our website or other payment providers.
AI Features and Automated Content The App includes automated AI-based features that analyse user inputs and generate informational content. These may include:
gemstone-related insights
automated informational texts
analysis based on user responses or photos.
AI-generated outputs:
may vary between users
may contain inaccuracies or incomplete information
may be generated automatically without human review.
All outputs are provided for informational and self-reflection purposes only. The Company makes no representations or guarantees regarding the accuracy, completeness, reliability, or usefulness of AI-generated outputs. You should not rely on such outputs as professional advice or factual conclusions. We may modify, update, or discontinue AI features at any time.
FaceMatch and Photo Processing Certain App features may involve analysis of photos provided by the user. Photos submitted for such features:
are processed solely to generate results
are processed temporarily
are not stored or retained by the Company
are automatically deleted after processing.
Photos are not used to train AI models and are not used for any secondary purposes.
User Content You may submit content through the App, including photos, notes, or questionnaire responses. You retain ownership of your content. By submitting content, you grant the Company a limited, non-exclusive licence to process such content solely for the purpose of operating and providing the App’s functionality. You represent that you have the rights necessary to submit such content.
Acceptable Use You agree not to:
misuse the App
attempt unauthorised access to systems or infrastructure
interfere with the operation or security of the App
use the App in violation of applicable laws or regulations.
Intellectual Property All intellectual property rights in the App, including software, design, text, graphics, branding, and functionality, are owned by or licensed to the Company. You may not copy, reproduce, distribute, reverse engineer, or modify any part of the App without prior written permission.
User Responsibility You are solely responsible for how you interpret and use any information provided through the App. You acknowledge that decisions or actions taken based on information generated by the App are made entirely at your own discretion and risk.
Third-Party Services The App relies on third-party infrastructure and service providers, including:
Amazon Web Services (AWS)
Firebase (Messaging and Crashlytics)
Apple and Google authentication services
Third-party AI service providers accessed through backend infrastructure.
These providers may process data only as necessary to operate the App. The Company is not responsible for the operation, availability, or policies of third-party services.
Disclaimer of Warranties To the maximum extent permitted by law, the App and all related services are provided “as is” and “as available”. The Company makes no warranties or representations regarding:
availability of the App
uninterrupted or error-free operation
accuracy of information generated by the App.
Suspension or Termination We may suspend or terminate access to the App if you:
violate these Terms
misuse the App
compromise the security or integrity of the App.
Termination may result in loss of access to certain features or content.
Indemnification You agree to indemnify and hold harmless the Company, its directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:
your use of the App
your violation of these Terms
your violation of applicable laws
content you submit through the App.
Limitation of Liability To the maximum extent permitted by law, the Company’s total liability to you for any claim relating to the App shall not exceed the amount you paid for the App during the twelve (12) months preceding the claim. The Company shall not be liable for indirect, incidental, consequential, or special damages. Nothing in these Terms excludes liability for:
death or personal injury caused by negligence
fraud or fraudulent misrepresentation
any liability that cannot be excluded under applicable law.
Sanctions and Export Compliance You may not access or use the App if doing so would violate applicable sanctions or export control laws.
Governing Law These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of England and Wales.
Changes to These Terms We may update these Terms from time to time. If significant changes are made, we will notify users within the App. Continued use of the App after such updates constitutes acceptance of the revised Terms.
Language The English version of these Terms prevails over any translations.
