These Terms of Use (“Terms”) govern your access to and use of the Gemiway mobile application (the “App”), operated by Gemiway Ltd, a company registered in England and Wales (“Company”, “we”, “us”, or “our”).
These Terms form a legally binding agreement between you and the Company. By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the App.
Purpose of the App The App provides automated, AI-assisted informational features designed to support self-reflection, personal insight, and exploratory use related to gemstones and user-provided inputs.
The App does not provide professional, regulated, or authoritative services and should be used solely as a supportive informational tool.
Eligibility and Age Requirement The App is intended for users aged 9 years and older. By accessing or using the App, you represent and warrant that you are at least 9 years old.
We do not knowingly provide the App to children under the age of 9 and reserve the right to suspend or terminate access if this requirement is violated.
Account Access and Authentication Access to certain features of the App may require authentication through third-party services such as Apple or Google.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
You may delete your account at any time. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.
Subscriptions, Payments, and Billing The App offers both free features and optional paid subscriptions, which may be available on a monthly or yearly basis.
All payments are processed exclusively through the Apple App Store or Google Play. Billing, renewals, cancellations, and refunds are governed by the policies of the respective platform provider.
We do not process payments directly and do not issue refunds. Any refund requests must be submitted through the relevant app marketplace.
AI-Based Features and Automated Content The App includes fully automated, AI-based features, including but not limited to:
analysis of user-provided inputs
personalized gemstone-related insights
informational texts generated or selected through automated systems
These features are provided for informational and self-reflection purposes only.
Results generated by the App:
are not final
may vary between individuals
should not be relied upon as advice, recommendations, or factual conclusions
You are free to accept, ignore, or disregard any output generated by the App. We may modify, update, or discontinue AI features or functionality at any time without prior notice.
No Medical, Psychological, or Therapeutic Services The App does not provide:
medical advice
psychological counseling
therapy
diagnoses
treatment
guaranteed outcomes or healing
The App is not a substitute for professional advice of any kind. You acknowledge that you use the App at your own discretion and responsibility.
User Content and Acceptable Use You may upload or submit content through the App, including but not limited to photos, notes, and questionnaire responses.
You retain ownership of your content. By submitting content, you grant the Company a limited, non-exclusive license to process such content solely for the purpose of operating and providing the App’s functionality.
You agree not to misuse the App, interfere with its operation, attempt unauthorized access, or use the App in a manner that violates applicable laws or these Terms.
Temporary Processing of Photos Photos uploaded for App features are processed with particular care. Such photos:
are processed temporarily
are not logged, backed up, or retained
are automatically deleted after results are generated
Photos are not used to train AI models or for any secondary purposes.
Third-Party Services The App relies on third-party service providers, including but not limited to:
Firebase (Messaging, Crashlytics)
Apple and Google authentication services
third-party AI services accessed via backend infrastructure
These providers process data only as necessary to enable the operation of the App and its features.
Service Availability The App is provided “as is” and “as available”, without warranties of any kind. We do not guarantee uninterrupted, timely, secure, or error-free operation of the App. The App may be unavailable due to maintenance, updates, or technical issues without liability to you.
Suspension and Termination We reserve the right to suspend or terminate your access to the App, with or without notice, if you:
violate these Terms
misuse the App
compromise the security or integrity of the App
Termination may result in loss of access to content or features.
Limitation of Liability To the maximum extent permitted by law, the Company’s total liability to you for any claim arising out of or relating to the App shall not exceed the amount you paid for the App during the twelve (12) months preceding the claim.
We shall not be liable for indirect, incidental, emotional, consequential, or special damages, even if advised of the possibility of such damages.
Export Control and Sanctions You may not access or use the App if you are subject to sanctions or export restrictions imposed by the United Kingdom, the United States, or other applicable authorities.
Assignment We may assign or transfer our rights and obligations under these Terms, in whole or in part, in connection with a merger, sale, restructuring, or other business transaction, without restriction.
Class Action Waiver You agree that any claims against the Company must be brought individually and not as part of a class, collective, or representative action.
Governing Law and Venue These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to These Terms We may update these Terms from time to time. Material changes will be communicated in-app. Continued use of the App after such updates constitutes acceptance of the revised Terms.
Language The English version of these Terms shall prevail over any translations.
